MDhome Terms of Use

Welcome to MDhome, Inc. ("MDhome," “our,” “us,” or “we"). We’re glad you’re here. A few important clarifications upfront: MDhome is not a doctor, healthcare provider, provider group, or medical service provider (collectively, the “Provider”). Rather, MDhome is a technology platform that allows you to book certain healthcare services, including, but not limited to, physician house calls or virtual visits on-demand or by appointment, 24/7/365.
These Terms of Use apply to your use of our website (www.mdhomecare.com), mobile applications, software, communication systems, and related services (collectively, the “MDhome Technology”).
By accessing or using the MDhome Technology, you agree to be legally bound by these Terms of Use (the “Terms”), as well as our Privacy Policy and the Provider Privacy Policy, which are incorporated herein by reference. If you do not agree with these Terms or our Privacy Policies, you may not use the MDhome Technology.

IMPORTANT: The MDhome Technology is not intended for use in medical emergencies. If you are experiencing a medical emergency, dial 9-1-1 immediately.

1. Eligibility and Use

A. Eligibility 

By using the MDhome Technology, you confirm that you are at least 18 years old, legally able to form a binding agreement, and located within a jurisdiction in which MDhome services are available (including the State of Washington). If you use the MDhome Technology on behalf of another person or entity, you represent that you have the legal authority to bind them to these Terms.

B. Provider Relationship

MDhome enables you to book services from Providers who are independent of MDhome. Providers are not employed by MDhome and are solely responsible for your medical care.

C. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the MDhome Technology for your personal, non-commercial use in accordance with these Terms.

D. Account Registration

To access most features, you must register and create an account using your phone number. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. Notify us immediately at privacy@mdhomecare.com if you suspect unauthorized access.

  • Use MDhome to violate any law or third-party rights

  • Reverse engineer or tamper with the MDhome Technology

  • Interfere with others’ use of the platform

  • Upload malicious software

  • Misrepresent your identity

  • Transfer your account or license without consent

2. Mobile and Third-Party Technology

Your use of MDhome via mobile applications may involve data usage or fees from your mobile carrier. MDhome is not responsible for those charges. If you download MDhome from an app store (Apple or Google), you agree to their respective terms.

3. Consent to Care

Booking a visit through MDhome involves consent to receive non-emergency healthcare from a licensed Provider. You understand that:

  • No results can be guaranteed

  • You remain responsible for seeking emergency or follow-up care

  • The Provider may determine you are not eligible for treatment through MDhome

You acknowledge receiving and agreeing to our Privacy Policies describing your health information rights under HIPAA.

4. Privacy

Our Privacy Policy and the Provider Privacy Policy describe how your personal and health information may be collected, used, or shared. By using MDhome, you agree to these policies.

5. Pricing and Payments

A. Charges

You will be shown pricing before booking and must prepay to confirm a visit. MDhome collects payments on behalf of Providers.

B. Payment Authorization

By providing a credit card, you authorize MDhome to process charges on behalf of the Provider. Your card may be securely stored unless you opt out.

C. Refunds

No refunds are issued after a visit is confirmed unless otherwise stated.

6. Connectivity and Access

You are responsible for maintaining the hardware, software, and internet connectivity needed to access MDhome. We reserve the right to update technology requirements without notice.

7. Intellectual Property

MDhome owns all intellectual property related to the MDhome Technology. You may not copy, sell, or modify any part of the platform without express permission.

8. Third-Party Links

We may link to or integrate third-party content. MDhome is not responsible for third-party practices or policies.

9. Termination

We may terminate your access at any time if you violate these Terms. You may cancel your account by emailing privacy@mdhomecare.com.

10. Disclaimers

The MDhome Technology and Provider services are provided “as is.” MDhome makes no guarantees about availability, accuracy, or outcomes of care. MDhome is not liable for Provider services.

11. Limitation of Liability

To the fullest extent permitted by law, MDhome’s total liability to you for any claims is limited to the greater of (a) $1,000 or (b) the amount paid by you in the past 12 months. We are not liable for indirect or incidental damages.

12. Indemnification

You agree to indemnify and hold harmless MDhome, its affiliates, and their respective officers and employees from any claims arising out of your use of the MDhome Technology or any violation of these Terms.

13. Dispute Resolution

All disputes will be resolved via binding arbitration in King County, Washington, under the rules of the American Arbitration Association. You waive the right to jury trials and class actions.

14. Changes to Terms

We may revise these Terms at any time. Changes become effective upon posting. Continued use of MDhome after changes means you accept the revised Terms.
